Terms of Service

The agreement
These terms are between you and BrewedOps (Kenneth Villar, Quezon City, Philippines) and cover your use of Kape Tools at kape.tools. By creating an account or signing in, you agree to them and to the Privacy Policy.
Accounts and access
- You can create an account by continuing with Google, which is open to anyone and needs no invite. Signing up with an email address and a password is closed at the moment, so Google is the way in. Either way your email address is your sign-in name, so it has to be an address you actually control and can receive mail at - disposable and throwaway mail domains are refused.
- If you sign up with Google we rely on Google having already confirmed the address, so your account works straight away. If you sign up with a password instead, the account does nothing until you click the confirmation link we email you.
- Signing in with Google on an address that already has a password account links the two, so either method then signs you into the same account. If that account had never confirmed its email address, linking it also clears the old password - whoever set it had not proved they owned the address.
- One account per person. Do not share credentials, do not sign up on someone else's behalf without their say-so, and tell us about any unauthorized use.
- Keep your password to yourself. You can change it from the account menu, and reset it by email if you forget it - a reset signs out every device.
- A new account is on the Free plan and stays there until you choose to pay for something. There is no signup trial and no countdown: the job boards, the job application tracker, the community, the music player, the Chrome extensions and every tool that runs inside your own browser are free for as long as you have an account.
- Paid access runs until its set end date. When a paid period lapses your account moves back to the Free plan - you are not locked out and nothing is deleted. You keep your account, your data and everything listed above; only the paid AI features stop until access is renewed.
- You can permanently delete your own account at any time from the account menu. It removes your account and the content it owns and cannot be undone. You can also ask us to do it by emailing [email protected].
- We may suspend or terminate accounts that break these terms.
Acceptable use
- No illegal use, no attempting to break, overload, or probe the service, no scraping the service itself, and no reselling access without written permission.
- Lead Finder returns publicly available business information. You are responsible for how you use it - comply with the Data Privacy Act, the anti-spam rules that apply to your outreach, and the terms of any platform you contact leads on.
- Global chat is shared space - no harassment, spam, or unlawful content. Admins may remove messages.
- Music player is for personal background listening in your workspace. You are responsible for making sure your use of any content complies with applicable law.
AI features
AI tools are powered by third-party models (including Anthropic's Claude API). Output is generated automatically and can be wrong, incomplete, or unsuitable - review it before you rely on it or send it to anyone. You are responsible for what you submit to AI tools and for how you use the output.
Your content
You own what you create in the workspace. You give us only the license needed to store, process, and display it back to you (and, for content you deliberately share - public playlists, global chat - to other members).
Payments
Kape Tools has a free tier and one paid plan, Pro (PHP 499 per month at the time of writing). Pro covers only the features that call a paid AI model on your behalf: KapeAI Agent Mode, the AI writing and transcription tools, and a larger KapeAI allowance. Everything else is free on every account - everything that runs inside your own browser, and also the parts we keep running for you, including the LinkedIn and JobStreet job boards, the job application tracker, the client list, the community, the workspace music player and the Chrome extensions. Pro can be paid a month, three months or a year at a time, and the longer terms cost less per month. Payments are arranged directly with us; there is no automated card processor and no card on file, so nothing renews by itself.
AI features on Pro carry a fair-use allowance rather than unlimited use. It exists so that one account cannot exhaust the shared AI budget that every member draws on, and it is set well above normal working use. The current figures are shown on the membership page inside the app, and we may adjust them as costs and usage change.
Payments are not refundable. The fee goes to the maintenance and running costs of the platform and is spent on the period it paid for. This applies to every term equally, including a three-month or one-year term paid up front. When a paid period ends your account is not closed - it moves back to the free tier with your data intact. The full position, including money sent to us by mistake, is in the No-Refund Policy, which forms part of these terms. Nothing in either document removes a right the law gives you.
If you process other people's personal data here
When you put personal data about other people into Kape Tools - your leads, clients, contacts or team - you are the personal information controller for that data and BrewedOps is your personal information processor, as those terms are used in the Philippine Data Privacy Act of 2012 (RA 10173). For customers subject to the GDPR, "controller" and "processor" carry their GDPR meaning. This section is the contract between us for that data. Email [email protected] if you need a countersigned copy for your records.
What is covered. All personal data we process on your behalf through your account, for as long as the account is active plus the wind-down and backup periods below. In practice that is whatever you choose to enter: business contact details, notes and files, about your leads, clients, customers and team. You are responsible for having a lawful basis to enter it and to instruct us to process it, and you should not upload sensitive personal information you do not need.
What we will do.
- Process that data only to provide the service, and only on your instructions - your configuration and use of the app being the documented instruction. If the law compels us to process it differently, we will tell you unless the law forbids us from saying so.
- Keep it confidential, and limit access to the people who need it to run and support the service.
- Apply the security measures described in the Privacy Policy: passwords stored as scrypt hashes, HttpOnly session cookies over HTTPS, a database not exposed to the internet, admin-only surfaces and rate limiting.
- Help you respond to data-subject requests - access, correction, erasure, objection - as far as the tools reasonably allow.
- Tell you without undue delay if we become aware of a personal data breach affecting your data, and give you what you reasonably need to notify the National Privacy Commission and the people affected within the 72-hour window the Data Privacy Act sets.
- Delete or return the data when your account ends or on your written request, except where the law requires us to keep it. Residual copies in routine backups are purged on the normal cycle, which is 14 days.
- Give you, on reasonable request, the information reasonably necessary to show we are meeting this section. This does not grant on-site audit rights beyond what the Data Privacy Act requires of a processor of our size.
Who else is involved. We use a small set of sub-processors, the same ones named in the Privacy Policy: Anthropic (the AI writing features; it does not train on inputs or outputs under its commercial API terms), Groq (transcription for the Subtitle Generator only), Cloudflare (traffic proxy, caching and object storage), Resend (account email only) and Hostinger (the server). You consent to these. If we add or change one in a way that affects your data we will update the Privacy Policy and, on material changes, note it where you sign in so you can object. These providers may store or process data outside the Philippines; where it leaves the country we rely on their contractual data-protection commitments, consistent with the accountability principle of the Data Privacy Act.
Liability under this section is subject to the limits set out below.
Service and liability
- The service is provided "as is", without warranties of uninterrupted availability or fitness for a particular purpose.
- Features may change, and third-party sources (search feeds, AI providers, media sources) can break independently of us.
- To the extent the law allows, BrewedOps is not liable for indirect or consequential damages, and total liability is capped at the amount you paid for the service in the 3 months before the claim.
Governing law
These terms are governed by the laws of the Republic of the Philippines. Disputes go to the proper courts of Quezon City, Philippines.
